Small Claims Tribunal Service

 

For Small Claims Tribunal or some of them call it as, “small claims court” in Singapore, there are guidelines as to how you can recover your monies from your businesses. First of all, the amount to recover, the strict guidelines  must be adhered to as follows:

1) The amount to be claimed, must be less than S$10,000.00. For more than $10,000.00, mutual agreement is required in written.

2) It must be within one year from the time of your clients’ defaulted payment. Meaning to say, one year upon the expiry of your invoice payment terms.

If you are the businessmen wanting to claim or recover your monies from your clients, if you cannot fulfil the above two strict guidelines, then Small Claims Tribunal in Singapore is not meant or suitable for you. It will be wasting your time and ours as well, if you want to pursue further.

The next important checklist for your type of claims, they MUST NOT under the following categories:

1) Hire purchase agreement.

2) Employment matters.

3) Personal loans.

4) Stock and shares.

5) Foreign exchange.

6) Rental (except for residential lease agreemnet not exceeding 2 years)

7) Legal fees.

8 Co-broking.

9) Insurance claims.

10) Damage caused by use of a motor vehicle.

However, the scope and powers of Small Claims Tribunal do include the following categories:

1) A contract for sale of goods (Eg, supply and delivery of goods like stationery, flowers, fruits, raw material, mineral water and so on).

2) A contract for a provision of services (It can be renovation, tuition, business consultancy or construction services and so on).

3) Arising from the respondent causing damage to your property.

4) A contract for a lease for residential premises which does not exceed 2 years.

5) A contract to buy or sell foreign currency notes made with a person holding a valid money changing and Remittance Business Act.

6) Cancellation of contracts under the Consumer Fair Trading (Cancellation of contracts) Regulations 2009

7) Refund of motor vehicle deposits with the Consumer Fair Trading (Motor Vehicle Dealer Deposits) Regulations 2009

8 Opt-out under Consumer Fair Trading ( Opt- Out) Regulations 2009

Of the above, for item 1) and 2) of the above scope and powers under Small Claims Tribunal,  they are the most popular claims at the Tribunal. Bearing in mind, anyone or companies not turning up  at tribunal hearing, Order of the Tribunals will be issued against the defaulter or respondent resulting in enforcement of order of tribunals like Writ of Seizure and Sale which can be very embarrassing to the respondent (or the debtor) should it happen.

Kindly note that, although it is “small claims” under the small claims court guideline for less than $10,000.00, but anyone lodging claims to Small Claims Tribunal is considered a legal action against the respective respondent or debtor. It should not be taken lightly as well and lawyers are not allowed to represent or present at the hearing or consultation.

To lodge or file a claim at the Tribunals, a party is required to pay a lodgment fee. The applicable lodgment fees are as follows:

Not exceeding $5,000 Exceeding $5,000 but not exceeding $10,000 Exceeding $10,000 but not exceeding $20,000

Kindly note the above lodgement fee is not our consultancy fee as this lodgement fee is the compulsory requirement to pay the Tribunals for the various amount that you would like to pursue in claiming. Not to worry about our consultancy fee and our hand on guidance, as it is reasonable and affordable. The bulk of the amount only collected upon your successful claim except for the initial adminstration fee. Unlike most lawyers, they would want at least S$2,000.00 upfront before their further works.
